State and Federal Laws About CBD
As a community, we at Moon Age are dedicated to providing our members with information and knowledge. We pride ourselves on being socially responsible, part of which is making sure the community knows the laws surrounding CBD. CBD can result from industrial hemp or marijuana crops. CBD has been legal since 2018 on a federal level, given that it is formed from industrial hemp. Legally, all industrial hemp CBD must contain less than 0.3% THC. Marijuana-based CBD typically has more than 0.3% THC. Laws do vary between medical versus recreational usage of marijuana-based CBD. Medical usage of marijuana-based CBD is prescribed or recommended by a doctor/medical professional. Recreational use involves not needing to have any form of prescription or recommendation from a medical professional. The laws surrounding usage varies at the state level. Find your state below.
Alabama
Hemp-derived CBD is legal for medical and recreational use, as long as it is less than 0.3% THC.
Alaska
Hemp-derived CBD is legal medically and recreationally, given that it has a concentration of less than 0.3% THC. In Alaska, marijuana derived CBD is also legal.
Arizona
Hemp-derived CBD is legal right now in Arizona. Selling and growing hemp-based CBD is also legal. However, be aware that it is still illegal to vape any form of CBD in Arizona.
Arkansas
Hemp-derived CBD is legal for medical and recreational use in Arkansas. California CBD products derived from hemp or marijuana are legal for medical and recreational purposes. It is illegal to put CBD products in pet food or to feed CBD products to pets.
Colorado
CBD products from hemp or marijuana are legal in Colorado.
Connecticut
Hemp-derived CBD is legal for medical and recreational purposes. Marijuana-based CBD is only legal for medical purposes and must be recommended by a doctor.
Delaware
CBD based from hemp is legal for medical and recreational usage. Marijuana-based CBD is legal for medical purposes, so long as it has a concentration of less than 7% THC.
Florida
CBD sourced from hemp is legal for Floridians. Under specific conditions, medical use of marijuana-based CBD is legal. These conditions include a concentration of less than 0.8% THC and at least 10% CBD. Florida has a list of medical conditions that allow for medical marijuana-based CBD. Please look here.
Georgia
Hemp-derived CBD is legal for medical and recreational purposes. Marijuana sourced CBD is legal for a variety of medical conditions due to the “Haleigh’s Hope Act” of 2015. These medical conditions include, seizures, sickle cell disease, and more. CBD oil can be sold and legally used, so long as it is less than 5% THC, with at least 5% CBD.
Hawaii
Hemp-sourced CBD is legal for medical and/or recreational purposes. Marijuana based CBD is only legal for specific medical purposes.
Idaho
CBD is still defined as being marijuana in Idaho, as it can be part of the plant. CBD, sourced from hemp or marijuana, is illegal in Idaho.
Illinois
Hemp-derived CBD is legal for medical and recreational purposes. Marijuana-based CBD is legal for medical and recreational purposes. CBD oil must have more than 0.3% THC.
Indiana
CBD sourced from hemp is legal in Indiana. It must have less than a 0.3% concentration of THC.
Iowa
Hemp-sourced CBD is legal in Iowa. The THC concentration must be less than 3% and come from industrial hemp to be counted as hemp-sourced. Marijuana-based CBD is only legal for medical purposes.
Kansas
Hemp-sourced CBD is legal, as long as it has less than 0% THC concentration. Marijuana-based CBD for medical and recreational purposes is illegal in Kansas.
Kentucky
CBD from industrial hemp is legal for all Kentucky citizens. Marijuana-based CBD is only legal for use in research at hospitals, higher education places, and clinical trials.
Louisiana
Hemp-sourced CBD is legal for medical and recreational purposes. CBD sourced from marijuana plants used for medical purposes are legal, but illegal recreationally.
Maine
Hemp-sourced CBD is legal for medical and recreational use in Maine. All CBD products sourced from marijuana are legal, medically and/or recreationally.
Maryland
Industrial hemp-based CBD is legal both medically and recreationally. Marijuana-based CBD is legal only for medical purposes.
Massachusetts
All forms of CBD are legal - hemp and marijuana-based.
Michigan
All forms of CBD are legal - hemp and marijuana-based.
Minnesota
Hemp-soured CBD is legal medically and recreationally. Marijuana-based CBD is legal medically as well, but not recreationally.
Mississippi
Industrial hemp-sourced CBD is legal for people in Mississippi. For marijuana-based CBD, it is only legal for severe epileptic cases. Even then, it must have a concentration of less than 0.5% THC and more than 15% CBD.
Missouri
Hemp-sourced CBD is legal for usage. Medical use of marijuana-based CBD is also legal, as long as it has a concentration less than 0.3% THC.
Montana
Hemp-sourced CBD is legal for both medical and recreational sources in Montana. Marijuana-based CBD is legal only for medical purposes.
Nebraska
CBD is highly restricted in Nebraska, as it is still considered part of marijuana. Both hemp-sourced and marijuana-sourced CBD are illegal in Nebraska.
Nevada
All forms of CBD are legal - hemp and marijuana-based, both medically and recreationally.
New Hampshire
Industrial hemp-sourced CBD is legal for medical and recreational purposes. Marijuana-based CBD is legal only for medical purposes.
New Jersey
Industrial hemp-sourced CBD is legal for medical and recreational purposes. Marijuana-based CBD is legal only for medical purposes.
New Mexico*
All forms of CBD are legal - hemp and marijuana-based, both medically and recreationally. *New Mexico is the first state to use CBD in treatments for PTSD.
New York
Industrial hemp-sourced CBD is legal for medical and recreational purposes. Marijuana-based CBD is legal only for medical purposes.
North Carolina
CBD sourced from hemp is legal for all uses in North Carolina. Marijuana-based CBD is only legal for medical use. These marijuana-based CBD products must have a concentration of THC less than 0.9%, and more than 5% CBD.
North Dakota
Hemp-sourced CBD is legal for medical and recreational purposes. CBD sourced from marijuana plants used for medical purposes are legal, but illegal recreationally.
Ohio
In Ohio, hemp-sourced CBD is legal for medical and recreational purposes. CBD sourced from marijuana plants used for medical purposes are legal, but illegal recreationally.
Oklahoma
Industrial hemp-sourced CBD is legal, as long as the THC concentration is less than 0.3%. If the THC concentration is any higher, it can only be used for medical purposes.
Oregon
All forms of CBD are legal - hemp and marijuana-based.
Pennsylvania
Hemp-sourced CBD is legal in PA. Marijuana-based CBD is only legal for medical purposes.
Rhode Island
CBD sourced from hemp is legal for any use in Rhode Island. Marijuana-based CBD is only legal for medical purposes.
South Carolina
Hemp-sourced CBD is legal for medical or recreational purposes. Marijuana-based CBD is illegal, unless it is used to help medically. Even then, it must be at least 98% CBD, with a concentration of less than 0.9% THC.
South Dakota
Industrial Hemp-sourced CBD is legal for any usage in South Dakota. Marijuana-based CBD is only legal for medical purposes and must be approved by the FDA.
Tennessee
CBD sourced from hemp is legal. Marijuana-based CBD is not legal. Texas CBD sourced from hemp is legal. Marijuana-based CBD is not legal. All products must be at least 10% CBD, and less than 0.5% THC.
Utah
Industrial hemp-sourced CBD is legal for medical and recreational purposes. Marijuana-based CBD is legal only for medical purposes.
Vermont
All forms of CBD are legal - hemp and marijuana-based for medical and recreational purposes.
Virginia
Hemp-sourced CBD is legal for medical and recreational purposes. Marijuana-based CBD is legal only for medical purposes.
Washington
All forms of CBD are legal - hemp and marijuana-based. Washington D.C. All forms of CBD are legal- hemp and marijuana-based.
West Virginia
Hemp-sourced CBD is legal for medical and recreational purposes. Marijuana-based CBD is legal only for medical purposes.
Wisconsin
Hemp-sourced CBD is legal for medical and recreational purposes. Marijuana-based CBD is legal only for medical purposes.
Wyoming
Hemp-sourced CBD is legal for medical and recreational purposes. Marijuana-based CBD is legal only for medical purposes.
